Note: The specific scope of work for any project will be defined in a separate proposal or contract agreement.

User Responsibilities

By using our services, you agree to:

  • Provide accurate and complete information when requested.
  • Use our services only for lawful purposes.
  • Not attempt to reverse engineer, decompile, or hack any part of our website or software.
  • Not use our services to transmit malware, viruses, or harmful code.
  • Respect intellectual property rights and not infringe upon materials provided by us.

Account Registration

If our services require you to create an account, you agree to maintain the confidentiality of your password and account details. You are fully responsible for all activities that occur under your account.

Flexion Infotech reserves the right to terminate accounts, remove or edit content, or cancel orders at our sole discretion.

Payments & Pricing

  • Quotes provided are estimates based on the initial scope of work.
  • Payment terms will be strictly as per the agreed contract/invoice.
  • Typically, a 50% advance payment is required to commence any custom development project.
  • We reserve the right to suspend services for late or non-payment.
  • All prices are exclusive of applicable taxes (GST) unless stated otherwise.

Refund & Cancellation

Our services involve custom creation of digital assets and code. Therefore:

  • Refunds: Generally, fees paid for completed milestones are non-refundable. If a project is cancelled mid-way, you pay for work completed up to that point.
  • Cancellation: You may cancel a project with written notice. Cancellation fees may apply to cover resources allocated.
  • Any third-party costs (server purchases, domain names, plugin licenses) incurred on your behalf are non-refundable.

Intellectual Property Rights

Client Ownership: Upon full payment, the client owns the specific deliverables (final code, custom design) created for their project.

Flexion Ownership: Flexion Infotech retains ownership of its background technology, reusable code libraries, frameworks, and developer tools used to create the deliverables.

You may not reproduce, distribute, or create derivative works of our website content or portfolio without our express written consent.

Project Delivery Terms

Delivery timelines provided are estimates. While we strive to meet all deadlines, delays may occur due to:

  • Delays in receiving client content or feedback.
  • Changes to the scope of work (Scope Creep).
  • Technical challenges unforeseen at the start.
  • Third-party service outages.

Confidentiality / NDA

We respect your business secrets. Any proprietary information, business ideas, or customer data shared with us during the course of a project will be kept strictly confidential and will not be shared with third parties without your consent. We are happy to sign a Non-Disclosure Agreement (NDA) before commencing work.

Limitation of Liability

To the maximum extent permitted by law, Flexion Infotech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of your use of our services. Or total liability shall strictly be limited to the amount paid by you for the specific service in question.

Disclaimer

Our services are provided “as is”. We make no warranties, expressed or implied, regarding the operation of your website or app, its visibility in search engines, or its ability to generate revenue. We do not guarantee that your website will be error-free or that it will be compatible with all future browser versions.

Third-Party Links & Tools

Our services may utilize or link to third-party tools, APIs, or websites (e.g., payment gateways, hosting providers). We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of India. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts in Surat, Gujarat.
